TERMS AND CONDITIONS: PACKAGE TOURS

1. GENERAL INFORMATION & SCOPE

These Terms and Conditions apply exclusively to Package Tours (services exceeding 24 hours or including overnight accommodation) booked directly with White Village Tours. By paying a deposit, you enter into a legally binding agreement and confirm you have read and accepted these terms without exception.

2. MANDATORY TRAVELLER REGISTRY (RD 933/2021)

In accordance with Spanish Law (Real Decreto 933/2021), we are legally required to report all traveller and reservation data to the Ministry of the Interior (SES.HOSPEDAJES).

• Data Submission: Within 24 hours of booking, the lead traveller must provide the following for all participants: Full name, Gender, Date of Birth, Nationality, ID/Passport Number, Support Number (for Spanish documents), and Residential Address.

• Signatures: All travellers aged 14+ must sign a traveller entry form (Parte de Entrada) before the tour commences.

• Compliance: Failure to provide this data within the legal reporting window may result in cancellation of the booking without a refund. Data is stored securely for 3 years as required by law.

3. BOOKING, PAYMENT & TAXES

• Booking Process: A booking is confirmed only upon receipt of a confirmation email from us.

• Payment Terms: A deposit of 50% is required to confirm a tour. For multi-day packages, the remaining balance must be paid 60 days before the trip start date.

• Mixed Tax Regime: As a 2026 travel agent, we apply a Mixed Operation for billing:

  • Accommodation/Logistics: Billed under the Régimen especial de las agencias de viajes (REAV). No VAT is itemised.

  • Bicycle Rental: Provided via our own fleet and billed under the General Tax Regime (21% VAT included).

• Invoicing: From 2027, your final invoice will include a Verifactu QR code for Spanish tax verification.

4. CANCELLATIONS & TRANSFERS

4.1 Cancellation by the Traveller

• 30+ Days Before Departure: 10% cancellation fee. Option for 100% future tour credit.

• 30 Days to 72 Hours Before Departure: 100% cancellation fee. Option for 75% future tour credit.

• Less than 72 Hours: 100% cancellation fee. No credit option.

• Right to Transfer: Under the Package Travel Directive, you may transfer your booking to another person who meets all trip conditions, provided you give us at least 7 days' notice.

4.2 Cancellation by White Village Tours

If we must cancel due to unforeseen circumstances, you will receive a full refund or the option to reschedule. We are not responsible for non-refundable personal travel costs (e.g., flights).

5. INSOLVENCY PROTECTION (MANDATORY)

In compliance with the Spanish General Law for the Protection of Consumers, White Village Tours maintains mandatory Insolvency Insurance. This guarantee ensures the refund of all payments made and, if necessary, the repatriation of travellers in the event of our insolvency. Occident GCO S.A.U. de Seguros y Reaseguros (Policy No: N-11.322.921-X).

6. HEALTH, SAFETY & LIABILITY

• Physical Condition: It is your responsibility to ensure you are in suitable physical condition and to inform us of any medical conditions or dietary requirements in advance.

• Inherent Risks: You acknowledge that cycling and mountainous activities are inherently dangerous and participate at your own risk.

• Helmets: We provide helmets free of charge. Under Spanish law, wearing a helmet is mandatory while cycling.

• Equipment Care: You are responsible for the care of the provided equipment. Damage caused by negligence or misuse will result in charges for replacement parts.

7. CONDUCT & TERMINATION

We maintain a zero-tolerance policy for verbal or physical abuse directed at staff, other guests, or property. Violations or failure to follow safety instructions may result in immediate termination of services without a refund.

8. GOVERNING LAW

These Terms are governed by the laws of Spain. Any disputes will be subject to the exclusive jurisdiction of the courts of Spain (specifically the courts serving Ronda/Málaga).
